The following terms constitute a legal agreement between you and Swifty ("Swifty," "we," "us," or "our"). Your use of swiftyai.dev (the “Site”) and the services made available on the Site (“Services”) is subject to these Terms of Service (these “Terms”). By using our services on the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations.
By using Swifty (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.
You agree to use the Service in compliance with all applicable laws and these terms. You are responsible for any activity that occurs under your account.
Some features require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You retain ownership of content you submit, including projects, source code, and media ("User Content"). By submitting User Content you grant Swifty a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and display the content as necessary to provide, operate, and improve the Service (including debugging, analytics, and displaying previews). You must not submit content that infringes others' rights, contains malware, or violates applicable law.
The Service uses AI models to produce generated source code, text, images, or other assets ("AI Outputs"). AI Outputs are provided for convenience and may contain errors, security vulnerabilities, or copyrighted material. You are responsible for reviewing, testing, and validating AI Outputs before deploying them. Do not rely on AI Outputs for safety-critical or regulated applications without human review.
We may use aggregated, de-identified usage data to improve the Service and our models. We will not use private project source code or explicitly private User Content to train models for other customers without your consent. If you opt-in to a program that allows training on your data, we will disclose the terms and provide controls to opt-out where required by law.
We may suspend or terminate access to the Service for any reason, including breach of these terms.
The Service is provided "as is". To the fullest extent permitted by law, we disclaim all warranties, express or implied.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWIFTY AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS (USD $100), WHICHEVER IS GREATER.
These Terms are governed by the laws of the United States of America. You consent to the federal and state courts located in the United States for any disputes arising out of these Terms.
